Scott R. Malyk is a Partner with Meyner and Landis LLP’s Immigration Law Department specializing in all aspects of corporate and business-related immigration law. Scott is a results-oriented attorney who represents a diverse group of domestic and multinational corporations and their foreign national employees, providing both short- and long-term guidance in connection with the hiring, transfer and retention of international personnel worldwide. This includes counseling business clients in areas of worksite compliance, including I-9 audits and investigations.
In servicing the business immigration needs of U.S. employers and their foreign national employees, Mr. Malyk either partners with inhouse legal and human resource personnel or manages the client’s foreign national workforce entirely in obtaining temporary and permanent (green card) visas for business, scientific, managerial and executive-level personnel. Through his substantial experience with all work-related visa classifications (H-1B, H-3, L-1A, L-1B, E-1, E-2, E-3, TN, O, P), he is able to provide both short-term and long-term guidance in the employer/employee relationship. Scott also has a wealth of experience pursuing litigation against the USCIS and related parties in the U.S. District Courts around the country.
Scott also represents the interests of self-petitioning foreign nationals seeking investment opportunities in the U.S., including Immigrant Investors seeking U.S. permanent residence under the EB-5 program. In addition, Mr. Malyk represents individuals in all types of employment-based immigration proceedings, including outstanding scientific researchers, medical professionals, foreign legal consultants and a variety of other persons of extraordinary ability in the sciences, arts, education, business, or athletics, who wish to come to the U.S. to work in their field of expertise. Such efforts include obtaining temporary and permanent visas for artists, musicians, celebrity chefs, professional athletes and a variety of other entertainers.
Scott brings with him the full resources of the Immigration Law Group of Meyner and Landis LLP, with a staff of 12 experienced attorneys and paralegals, which has been representing corporate clients in business immigration matters for over 30 years. Scott is also past Chair of the Immigration Law Section of the New Jersey State Bar Association and he currently serves as a Member of the Board of Trustees of that organization. He is a frequent speaker on corporate panels and has a number of published articles on various business-related immigration topics, including New Jersey Law Journal, New Jersey Lawyer Magazine, the American Bar Association’s Employment and Labor Relations Law Newsletter and the New Jersey Law Journal’s Employment and Immigration Law Regional General Counsel Supplement.
Recently, Scott was selected as a recipient of the prestigious “Lawyer of the Year” award for 2022 for the practice area of U.S. Immigration Law by U.S. News and World Report’s “Best Lawyers in America” list. He was also selected for inclusion in the highly regarded Chambers USA rankings for the practice of U.S. Immigration Law from 2020-2022, as well as the U.S. News and World Report’s “Best Lawyers in America” list from 2019-2022 and a “Superlawyer” in the New Jersey Super Lawyers Magazine from 2009-2022.
Scott is a graduate of Lafayette College and Seton Hall University School of Law. He is licensed to practice in New Jersey and New York but counsels corporate and business clients in almost all 50 states.
