Prison Precaution and Principle of the prohibition of self-incrimination


The Supreme Federal Court of Brazil recently ruled that the accused’s refusal to provide his cell phone password is not a sufficient argument to order a precautionary arrest, given that the Federal Constitution of Brazil and the San Jose of Costa Rica Pact establish the fundamental principle of law the prohibition of mandatory self-incrimination.
